2. PURPOSE AND SCOPE

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, govern the sale of products offered through the website www.offsvvva.com.

These Terms apply to purchases made by consumers and users within the meaning of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, hereinafter referred to as the “Consumer Act”.

By placing an order, the buyer confirms that they have read, understood and accepted these Terms.

3. CAPACITY TO CONTRACT

To place an order, the buyer must be of legal age and have full legal capacity to enter into a contract.

4. THE PRODUCTS

SVVVA pieces are handcrafted jewellery made individually by hand after each order is received.

As a result of the handcrafting process, there may be small variations in finish, texture, tone or weight between pieces. These variations do not constitute a defect or lack of conformity, but form part of the handcrafted nature of the product.

The photographs shown on the website are representative. Colours may vary slightly depending on the screen and device used.

Information about the materials, weight, dimensions and finish of each piece is provided on its product page.

5. PRICES AND TAXES

All prices are shown in the currency selected by the buyer and include Value Added Tax, where applicable, for deliveries within Spain and the European Union.

Shipping costs, where applicable, are calculated and itemised during checkout before the purchase is confirmed.

Duties and import taxes

For deliveries outside the European Union, SVVVA covers any applicable duties and import taxes. The buyer will not have to pay any additional amount upon delivery.

If, due to an error or a regulatory change in the destination country, the carrier or customs authority requests payment upon delivery, SVVVA will reimburse that amount in full upon presentation of the corresponding receipt at info@offsvvva.com.

SVVVA reserves the right to modify its prices at any time. The price applicable to an order will always be the price displayed when the order is placed.

6. PURCHASE PROCESS

The purchasing process consists of the following steps:

Select the piece, material and, where applicable, size.
Add the selected product to the shopping cart.
Proceed to checkout.
Enter the contact, shipping and billing details.
Select the shipping method and payment method.
Review the order summary and the itemised total price.
Confirm the order and complete the payment.

Before confirming the order, the buyer may review and amend the information provided and correct any errors.

Once payment has been completed, an order confirmation email will be sent to the address provided by the buyer. This email constitutes confirmation of receipt of the buyer’s acceptance for the purposes of Article 28 of the LSSI-CE.

The contract will be concluded in Spanish or English, depending on the language in which the website was browsed at the time of purchase.

SVVVA retains an electronic record of each order through Shopify. The buyer receives an order confirmation by email and may request a copy of their order details by writing to info@offsvvva.com.

7. PAYMENT METHODS

The following payment methods are accepted:

Credit or debit card through Shopify Payments, including Visa, Mastercard and American Express.
PayPal.
Klarna.
Shop Pay, Google Pay and Apple Pay, where available.

Payment in three instalments may be available through PayPal or Klarna, subject to the conditions and approval criteria of the corresponding payment provider.

SVVVA does not participate in the decision to approve or reject the financing and is not responsible for the conditions imposed by the payment provider.

8. PRODUCTION, SHIPPING AND DELIVERY

Production and dispatch

Each piece is made by hand after the order is received.

The estimated production and dispatch time is approximately one week.

This period refers to the time required for the order to leave the SVVVA studio. The corresponding transit time must be added to this production period.

During periods of high demand, production or dispatch may be delayed. Where appropriate, the buyer will be informed by email.

Estimated delivery times

The following estimated delivery times apply from the date of dispatch:

Spain: approximately 3 working days.

European Union: approximately 5 to 7 working days.

Rest of the world: approximately 7 to 13 working days.

These delivery times are estimates and may vary due to circumstances affecting the carrier, customs procedures, public holidays or other circumstances outside SVVVA’s reasonable control.

Tracking

Once the order has been dispatched, the buyer will receive an email containing the available tracking information.

Statutory maximum delivery period

Unless expressly agreed otherwise, delivery will take place within a maximum of 30 calendar days from the conclusion of the contract, in accordance with Article 109 of the Consumer Act.

If delivery cannot take place within that period, the buyer may terminate the contract and obtain a full refund of the amounts paid, in accordance with applicable legislation.

Delivery problems

If an order arrives damaged or incomplete, contains an incorrect product or does not arrive, the buyer must contact info@offsvvva.com and provide:

The order number.
A description of the incident.
Photographs of the parcel, packaging and product, where possible.

Damaged, defective, incomplete or incorrect orders will always be handled at no cost to the buyer.

Transfer of risk

The risk of loss of or damage to the products passes to the buyer when the buyer, or a third party indicated by them other than the carrier, takes physical possession of the goods.

9. RIGHT OF WITHDRAWAL

This section explains the statutory right of withdrawal available to consumers.

It is separate from the voluntary commercial returns and exchanges policy described in clause 10, which offers additional benefits.

9.1. Withdrawal period

Consumers have 14 calendar days to withdraw from the contract without giving any reason and without penalty.

The withdrawal period begins on the day the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the goods.

9.2. How to exercise the right of withdrawal

To exercise the right of withdrawal, the consumer must notify SVVVA of their decision before the withdrawal period expires by means of an unequivocal statement sent to:

The withdrawal form included at the end of these Terms may be used, although its use is not compulsory.

9.3. Consequences of withdrawal

In the event of withdrawal, SVVVA will refund all payments received, including the standard outbound delivery costs, without undue delay and, in any event, within a maximum of 14 calendar days from the date on which the decision to withdraw is communicated.

The refund will be made using the same payment method used for the original purchase, unless expressly agreed otherwise. No additional charge will be made for the refund.

If the consumer selected a delivery method other than the least expensive standard delivery option offered by SVVVA, the additional cost will not be refunded.

SVVVA may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been returned, whichever occurs first.

Return shipping costs

When the withdrawal is due to a change of mind, the consumer must bear the direct cost of returning the goods.

SVVVA will bear all return costs when the return is due to:

An error made by SVVVA.
A defect in the piece.
Delivery of an incorrect product.

In all cases, regardless of who bears the return shipping costs, SVVVA will refund the standard outbound delivery costs.

Condition of the returned goods

The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

The goods must be returned without undue delay and, in any event, within a maximum of 14 calendar days from the date on which the withdrawal is communicated.

9.4. Exceptions to the right of withdrawal

In accordance with Article 103 of the Consumer Act, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.

To avoid any ambiguity:

Catalogue pieces purchased in one of the sizes offered on the website are subject to the right of withdrawal, even when they are made individually after the order is received.
Made to order is not the same as personalised.
Pieces made in a size not offered on the website are not subject to the right of withdrawal.
Engraved pieces are not subject to the right of withdrawal.
Pieces incorporating a modification specifically requested by the buyer are not subject to the right of withdrawal.
One-off bespoke commissions are not subject to the right of withdrawal.

For personalised commissions, SVVVA will expressly inform the buyer of the loss of the right of withdrawal before accepting the commission and before receiving payment.

The buyer’s express confirmation will also be requested.

10. COMMERCIAL RETURNS AND EXCHANGES

In addition to the statutory right of withdrawal described above, SVVVA voluntarily offers the following commercial returns and exchanges policy.

Returns

A return may be requested within 15 calendar days of receiving the order.

To request a return, contact info@offsvvva.com and include:

The order number.
The name of the piece.
The reason for the return.

Size exchanges

The first size exchange is completely free.

SVVVA will cover:

The cost of returning the original piece.
The cost of sending the replacement piece.

From the second size exchange relating to the same order onwards, the shipping costs must be paid by the buyer.

Condition of returned pieces

Pieces must be returned:

Unworn.
Without signs of use or damage.
In their original packaging.

Bespoke and personalised pieces

Made-to-measure, bespoke or personalised commissions cannot be returned or exchanged, except in the event of a manufacturing defect.

11. LEGAL GUARANTEE OF CONFORMITY

All products are covered by the three-year legal guarantee of conformity from the date of delivery, in accordance with Articles 114 and following of the Consumer Act.

If a product does not conform to the contract, the consumer may choose between repair and replacement, unless one of those remedies is impossible or would impose disproportionate costs compared with the alternative remedy.

The consumer may request an appropriate reduction in the price or termination of the contract in the circumstances established by applicable legislation, including where:

Repair or replacement is impossible or disproportionate.
SVVVA has not completed the repair or replacement within a reasonable period.
The lack of conformity persists after an attempt to repair or replace the product.
The lack of conformity is sufficiently serious to justify an immediate reduction in price or termination.

All legally required remedies will be provided free of charge, within a reasonable time and without significant inconvenience to the consumer.

During the first two years following delivery, any lack of conformity that becomes apparent will be presumed to have existed at the time of delivery, unless proven otherwise or unless that presumption is incompatible with the nature of the product or defect.

The right to bring a claim expires five years after the lack of conformity becomes apparent.

The following circumstances are not, by themselves, considered a lack of conformity:

Natural wear resulting from normal use.
Surface tarnishing of silver, which is inherent to the material and can be reversed using the cleaning method described in the care guide.
Gradual wear of gold plating through normal use.
Damage caused by misuse, impact, contact with chemicals or handling or alteration by third parties.
The handcrafting variations described in clause 4.

These exclusions do not limit any mandatory rights available to consumers under applicable legislation.

SVVVA will acknowledge receipt of complaints and respond as quickly as reasonably possible.

13. ALTERNATIVE DISPUTE RESOLUTION

SVVVA is not currently affiliated with an alternative consumer dispute resolution scheme.

Consumers may contact the public consumer protection bodies in their place of residence.

For cross-border purchases within the European Union, consumers may also contact the European Consumer Centres Network, known as ECC-Net.

14. FORCE MAJEURE

SVVVA will not be liable for a failure or delay in performing its obligations when the failure or delay results from force majeure or circumstances beyond its reasonable control.

15. SEVERABILITY

If any provision of these Terms is declared void, invalid or unenforceable, that decision will not affect the remaining provisions, which will remain in full force and effect.

16. AMENDMENTS

SVVVA may amend these Terms when necessary.

The Terms applicable to each order will be those in force and accepted by the buyer at the time the order is placed.

Changes made after an order has been placed will not apply retroactively to that order.

17. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law.

For contracts concluded with consumers, disputes will be submitted to the courts determined by applicable consumer protection legislation, including the courts of the consumer’s place of residence where legally applicable.
